I want to know what the standard leave policy is in Maharashtra because my current employer has made provisions for 4 mandatory public holidays and only 12 paid leaves annually (with no provision for SL/CL, etc.). Additionally, I am interested in understanding any specific leave policy for the death of an employee's immediate family member. As an HR professional, I aim to provide proper suggestions. Please guide me on this matter. Also, I would like to know if there are any legal implications regarding the existing leave policy mentioned above.

Statutory leaves are compulsory as per the Act under which your establishment is covered. If your establishment is covered under the Shops and Establishment Act, then please refer to the Maharashtra Shops and Establishment Act and follow the leave rules as stipulated there.
Regarding National/Festival Holidays, it is 4 National Holidays and 5 Festival Holidays to be given to employees. Festival holidays are as per the important festivals of your jurisdiction.
Concerning leave for the immediate family member's death, it is employer-specific. Either separate leave may be considered, or it can be adjusted from the accrued leave account of employees.
