I have a Query-
If one employee take leave from Monday to Saturday ( 6 days), should we included both Sundays as leave if he joins on Monday. As per law can we count it 8 days leave.
Please suggest.

Dear Durgesh, You can consider it for 7 days as one Sunday should be consider as weekly off only. Weekly off is his lawful right after continuous working for 6 days in the preceding week.

First of all look into the company leave policy because it matters as per statutory.
If any employee took leave from first day of the week to end date of the week then you have to considered only start date to end date..eg. Monday to Saturday( Sunday Week off) then 6 days, Monday to Friday ( Saturday & Sunday week off) then 5 days.
But if any employee took leave at a stretch from previous week to next week then it will count the weekly off...eg.
Leave from Thursday to Tuesday-Join on Tuesday or Wednesday( If Tuesday then 5 days & if Wednesday then 6 days).

First of all look into the company leave policy because it matters as per statutory.

First of all you need to note that any employee after working for 48 hr a day rest with pay to be given hence the first Sunday to be Weekly off with pay. As far as the other 6 days are concerned he has not worked hence those 6 days and once he has not worked for 48 hrs then the rest day with pay didn't arise.
In case the employee is on Earned leave then he is eligible for W.off with pay.
Over and above this your leave policy / Certified standing orders supersedes & pay as per the rules therein.

Especially, when an employee is Sick or on Sick leave or has to attend sick member from his immediate family, and if his leave is counted for Sunday, it is not his fault. Similarly, for Exam leave / Study leave, one has to bear Sunday as leave. So it is advisable, you can devise your own leave policy and frame your own rules considering the situations / reasons.
