Can anyone due to health reasons take a Sabbatical... one of my employees is on continuous leave due to health reasons.... in case we need to retain the employee... can the person take a sabbatical for some time...

Dear Nidhi,

"Sabbatical leave" is granted when an employee wants to pursue some higher study. On completion of the study, he/she can rejoin. Companies provide sabbatical leave so that employees can pursue higher education and when they rejoin, the employee knows the culture of the company very well. However, your case is different. The employee cannot join the duties due to a medical problem. Then why not keep the employee on the rolls of the company and not remove him/her? Employees can have "Leave Without Pay" (LWP) as many days as his/her company is ready to spare. Since there is no payment to the employee, there is no question of payment of PF, ESI or PT.
