Hi All, can we keep the employee without salary in probation period, Regard Sumit
From India, Gurgaon
Hi Sumit,
I have heard that some companies do not pay stipend during internship period. But, when we are hiring employees on a probation period, they will continue to be an employee (temporarily) for a company. It is necessary to provide salary in this period and the descent hike on successfully completion of the same.

No you cannot keep an employee without salary in probation period.
What is the concept of probation period??
A process or period in which a person's fitness, as for work or membership in a social group, is tested.
So employee is a regular employee who is entitled for full pay.

When you hire an employee, you need to pay him. Whether he is in probation or not is immaterial
That is the law in india specified in payment of wages act.
And you have to pay above minimum wages.
The only way you may not pay someone is if they are pure very short term trainees. And they would be actually trainees, here to learn not expected to delivery any significant result to the company
Even if you are hiring apparentices, they have to be paid.

Take..them as a trainee...pay them..some allowance...No Labour law is applicable..they will be apprentice not amounting to statutory apprentice under the apprentice act...as per standing orders...act they need to be paid some allowance as per applicable standing order
