I am a woman and was working in a private company for last 3 years. i have given my resignation on february 2015 and got relieved. Now the employer is passing false claim that i was asked to leave when anyone contacts for background verification. this is affecting me to seek a new job. how to handle this situation

We really feel sorry for your state of mind. Now this sort of personal vindication is order of the day. you face it with courage. do not let down by your own feeling. explain your stand to the prospective employer and ill attitude of your previous employer. may be one or two offer go, but if you are untired, you can win the battle with your own wisdom & knowledge. keep posting.

What does your relieving letter say?

Did you leave with after differences of opinion etc or for better prospects/job change?

Did you follow all rules for resignation from earlier company?

If you have followed all rules and got proper release and still they speak wrong verbally,speak to your old company management and try and see where exactly is the problem.

Try and find out who in the earlier company is speaking bad or what you claim 'wrong information" and obtain clarifications.

Problem with such verbal badmouthing is the prospective employer will just not tell anything but will not call you for interview or hiring process.

One must find out what exactly is being spoken abut you behind your back to prospective employers and sort it out frankly and openly.

It is a competitive world and companies will take safer route and hire somebody else if previous employer speaks bad(even if it is wrong or with different motive)

But face it boldly and show a positive outlook when dealing with prospective employer.

Your positive outlook will definitely be noticed and job will be given to you if otherwise you meet all other QRs.

Send a legal notice through lawyer describing details of harassment being given by your previous employer citing incident of sexual harassment as defined under the Prevention of Sexual Harassment Act at workplace and the threats of false claims projected by him in relation to your future job prospects as specified under section 3(2) of the Act. Ask for written apology from him within 3 days and assurance that he will not project any such false claim to any one and to keep the legal notice as confidential in terms of section 16 of the Act. I think he will behave himself and desist otherwise pursue further.

Hello,
I suggest you as everybody suggested to present your approval papers.
Let them verify and get negative feedback. Do not say any thing about person that he gave wrong feedback. Just present your papers and give HR interview. You do not have to feel victimized by some body misleading behavior. Just say that I can not comment this is experience that speaks. Do not think this again and again.

do your own background check with the company without revealing your identity and take it on the email . If they say or write anything negative , use it as a proof and file an FIR.

By resorting to this dubious method you are exposing yourself to various penal provisions under IT Act which may damage yourself because when the ex employer will send information to an impersonator even, he will obtain commitment not to reveal to anyone. If later he comes across through FIR that he was trapped, he will fire his salvos. He may escape himself because of his using a circumventous language even contrary to record but it will become more difficult for yourself.

Implicating someone in sexual harassment case is in no way appropriate , just because victim is a female .she has no where mentioned about sexual harassment.

A past employer will not chase to harass an ex employee to whom he has given clean chit by threatening to doom his/ her future through false allegation. This is obviously to force one to surrender to his illegal terms. A woman will not describe ipsi Dixies of such allegations which are required to be kept confidential under the said Act. A past employer on the contrary wishes good luck and best wishes for an obedient employee. So sometimes some reasonable assumptions have to be derived.One should not expect that she should beg the past employer for mercies for not making any false allegations to prospective employer.

Write an email to your ex employer stating whats happening and attach the copy of your relieving letter and the copy of the resignation letter, if they have acceptance seal and signature on it. Ask your ex employer, why they have been resorting to such cheap antics and why you should not initiate a legal action against them. This mail must also be copied to the labour officer, whose contact you can get through the local labour office.
Your reaction must be purely based on the response you get. However, I guess this is normally enough to shake your ex employer
