Normally the Maternity Leave will be eligible for 6 weeks prior to delivery and 6 weeks after delivery. But one cannot assess exactly the delivery time. Hence 12 weeks will be allowed in total in practice. Please follow the same.

It should be 6 weeks prior to your expected date of delivery and 6 weeks after the delivery. In some cases a woman suffering illness arising out of pregnancy, delivery, premature birth of child or miscarriage shall, on production of such proof as may be prescribed, be entitled in addition to the period of absence allowed to her under section 6, or, as the case may be, under section 9, to leave with wages at the rate of maternity benefit for a maximum period of one month.

• 10 weeks before the date of her expected delivery, she may ask the employer to give light work for a month. At that time she should produce a certificate that she is pregnant.
• She should give written notice to the employer about 7 weeks before the date of her delivery that she will be absent for 6 weeks before and after her delivery. She should also name the person to whom payment will be made in case she can not take it herself.
• She should take the payment for the first six weeks before she goes on leave.
• She will get payment for the six weeks after child birth within 48 hours of giving proof that she has had a child.
