I was working with an Pvt Company i send them a resignation dated 08-09-2011 on project managers email id keeping my TL in the loop but didn't got any acknowledgement.

I continued till 31-12-2011 as per the contract at appointment for notice period of 2 months and in this case i served more than 2 months,after which due to some family tragedy i discontinued coming to office.

After sometime i got a job in another company who demanded relieving letter of my previous employer which i inquired from Project manager.,who told me that he will telling HR and after few days i got a call from TL saying that got a relieving letter for you from project manager and he forwarded it to my mail which i submitted to my new company.

After verification from my company they informed me that my previous company is not endorsing the document,when i told my project manager and HR about all this they tell me that you have not put your resignation neither on mail nor on HR crest(which was not in appointment terms) and are not willing to give any relieving letter.

On showing the project manager the resignation mail he is pointing that the mail id i had put is wrong and i didn't received any.

I would like to know

1. if they thought that i hadn't put my resignation and was absconding from duties after 31=12 2011 is it not the HR policy to send the show cause notice.

2 Can the company stop my relieving letter.

please suggest me how can i get it as i have already lost my job due to their neglegence till now neither responding mails nor recieving the telephone calls

I appreciate that you have served the full notice period of 2 months as mentioned in your appointment order. But I fail to understand why you decided to abruptly stop reporting for work (for whatever reasons). Now I am surprised that you are citing that your previous company is negligent.

Though it is an accepted practice that the resignation letter through e -mail is acceptable, I am unable to understand from your e - mail as to whether the resignation e - mail was sent from from the official e - mail ID provided to you by your previous company. On the other hand if you had forwarded the resignation through some other persons official e - mail ID then it may be invalid.

The only way for you now is to approach your previous company TL & Project Manager, explain them the situation that led to your exit and sort out the matter amicably.

Some employees feel (I certainly don't mean you) that the new company will take them without verifying their past employment career. Professionally managed companies insist on relieving letter from past employers in some cases if the duration of stay in past employment is very short even past employment relieving letters are verified and also they seek reference from past employers. If the association in those companies has been smooth then the candidate does not feel any hassle.

Best way out for you is to sort out the matter with your previous company, atleast you do not have a choice now. Do not open up the topic of sending show cause notices etc, it will only aggravate the problem.

As Mr. Kannan rightly saud, it is fully on your, for that matter; any employee's, interest to seperate amicably. Unfortunately or otherwise, I regret to say that our younger generation always demonstrates their temptness to severe the relations also while parting. This is absolutely not in favour of any career abitious person.
I personally feel & believe that exit should also be as hounarable as entry !!

Like to work out what you said.....

1) first you resign, sending mail to a wrong ID,

2) Then some family tragedy. you stop going and simultaneously your notice period is over.

3) You join some where and instead of reliving letter submitted that E Mail.

4) Only after previous employer decision you got time to discuss the resignation sent through mail fith Project Manager

5) Only then he pointed out you sent on wrong ID. (More like sending a letter with out address....)

If above is right then I need not be James Bond, all above are simply not in order. And I can really feel story is just other way round.

I am sure they must have paid your dues (i.e. salary in full) and if you fight you will get your PF(sooner or later).

The only thing they can do is stop you experience or reliving letter,(which I am sure they should).

Any way as Kannan and Anil already say fault seems to be from your side only. Requested to please visit Project Manager and apologies for what you did.

It seems to me that this e mail thing can lead you to cyber fraud, please act quickly and close this issue ASAP.

I would like to add here that the company has deputed me at clients site and i had sent the resignation from the email id that the client has provided me for communication with its internal employees.Moreover project manager has also sought me then to hand over the belongings like i card to the TL for the location meant that he was known to it that i have put my resignation and therefore the show cause notice was to be served though i already served notice period.Also the fact is that they have forwarded me a relieving letter which as per them is not theirs hence fake.

Moreover my performance and conduct has been good at the site and the staff at that location have been appreciating it time to time....why should i part from my employee w/o intimating when i know the repurcussions.

Dear can they stop my relieving letter and if i get experienced letter from them does that mean that i had worked but still something pending for clearence or employers see relieving letter from immediate previous employee only.

Does company has the say in giving or not the relieving letter or it is employees right ( i suppose that even a terminated employee gets his sevice certificate)

If the employee is absent or absconding from the office isn't it the duty of HR and Project Manager to know the reason behind it ,isn't it the HR policy to sent a show cause notice which they haven't adhere to and moreover as written in previous comment of mine the project manager has told me to hand over the belongings to TL hence he was know to it.I don't think it is cyber fraud.
What steps i should take now to close this issue

I haven't produce any email instead of relieving letter as pt in your pt 3.
i had recieved relieving from them which they are not endorsing now citing that they have not provided any.they disown that letter

Official Resigning practices guides that the person shall submit his resignation in person to his immediate reporting authority, shall express his final decision to quit the employment and ask for the smooth relieving on completion of notice period.

If, in case, immediate authority or the HR authority denies to accept the resignation or denies to provide acknowledgement of the resignation letter, it right on the part of the employee to use the internet communication mode for submission of resignation, in which he has to clarify the fact that he had submitted the resignation in person which was not accepted and acknowledged by the company and hence he is submitting the resignation by e mail. While doing this , the employee also shall clearly mention his last date of working and inform the company to complete his clearance formalities.

The mail shall be sent from the official mail ID provided by the company and copy shall be marked to personal mail ID by the employee.

No, in this case you can take the reference of the mail communication and also shall clear that you have completed the notice period by statute.

Dear Sohail ,

Let i give you a simple rule of resignation .

1. If you want to put resignation , you have to send to your senior ( To ) and Hr department ( CC ) .

2. You have to take reply from either your senior or your Hr department that they seen it and revert back to you soon .

3. Before leave any organization you have to take three documents .

1. Experience certificate which show that you worked over their .

2. Salary certificate & Salary slip if you don't have .

3. Relieving certificate & Please complete No Objection Process .

If you did not complete this process you will face problems from Hr department .

Never ever think about show cause notice it will waste your time & It will cause you in future when any MNC will call for your past record .

My suggestion is talk to your TL and apologize with him/her and also Hr department.

I am sure they will consider your apoligize and complete other process.

If they are not ready to complete that process So SPEAK THE TRUTH TO YOUR CURRENT ORGANIZATION HR DEPARTMENT . [ THEY WILL UNDERSTAND IT IF YOU ARE VALUABLE FOR THEM ]
