Hi Seniors,
Please advice on this.
I am working for an IT company as Tech. Support since six months. Now there is an family emergency in my native and I must go but I am sure I am not coming back. In my offer letter they had mentioned I have to pay Rs.2 lakhs as Training cost if I leave the company within two years period and also I have to serve two months notice period. I am ready to serve notice period but I cannot pay 2 lakhs. If left the company without notice period and such amount will it be affect my future. I hope six months gap doesn't matter. Is there any way to relieve the company without paying 2 lakhs. Any suggestions or advice. But I must go to my native.

You have only three option here :
1) pay the amount on serving the notice period ,
2) talk to your management and narrate the whole thing about your crisis if the management agrees you may have no other problem leaving the company,
3) ask the management, after explaining your issue, try to give the evidence of your emergency situation, in case if they feel it genuine they may suggest you through the further process upon you request to deal with it as they deem fit.........
you try replacing the candidate with the similar caliber suiting your job requirement, is the company accepts it.......
the last resort would be to take the support of the court, if you are lucky it may grant you the relief or reduce the compensation or any other relief which may deem fit........
But explaining politely and making the management understand the emergency is always the best option...........

Dear Mr. DVJ2012,
You are contardicting your own question in 3 different ways :
1. You have (must) leave the company regarding your personal/ family issues.
2. You may have to serve the notice period to avoid the payment of 2 lakhs which is incurred as a training cost
3. Does not really hassel you, an experience gap of 6 months as you do not want to serve the notice period
Hitherto, you might have to answer few queries to accede give you better solution.
- When you know that you ain't coming back, then why do you have to keep the employer in dark?
- When you are ascertain to the situation of paying 2 lakhs, why would you not give a notice and do yur F&F settlement?
- Now-a-days, even a gap of 3 months, upshots any employer to volte-face in deploying, why would you really like to take a chance?
-You exclaimed it a training cost, have they given you any training relating to the process?
- 2 year period (as mentioned in your query), was this a contract/bond or written in any part of your letter of appointment?
- Are you a confirmed employee or are you still under probation?
Please mention the above, We might guide you to surpass this situation.

Hi
Agree with Sharmila das and others.
while coming to interview most of freshers have not changed understanding skills, business opportunities and time frames in executing the customer point of view. When frshers land in offices during training period, they will be thinking that doing job is as easy as attending exam. the real world is different. They find many reasons for leaving organisation.
The business is search and explore for opportunities and convert into realities. It is the crux of business.
yougster are capable of understanding the same but hardly pay attention to the future issues and come on to the table for discussion. A quick decision from them zeoparadise whole schedules.
some companies for short term gains, attract and lure them . And create unsusatainble market condtions.
as you see the attrition rates are uncontrolable despite many retention policies are in the available in companies.
it is role of HR and tech teams, to explain the reasons to mitigate losses in the event of leaveing middle of contract period and expain consequences on displinary actions and not giving an opportunity to another aspiring candiate at the time of their joining.

You have to pay the bond amount unless the management waive it.Without it u will not get exp certificate or relieving order.Right of service certificate is only for workmen under Standing orders Act.
