Hi All,
I joined HCL Tech. in Bangalore and was subsequently transferred to HCL Germany. In HCL Germany the notice period is one month while in HCL India it is 3 months. Last week, I resigned from my job in HCL Germany (just two weeks before scheduled return to India) and I'm willing to serve the 30 days notice period.
Now I have been told that as soon as I reach India my notice period will increase to 3 months.
Can someone please let me know if this is valid as I have resigned while in Germany?

Dear Akhil,
Please check the agreement you have signed before your transfer to Germany.
Check for the jurisdiction.
I believe you have got a intra company transfer.
As per my experience goes, generally employee are kept under the jurisdiction of the appointing country. So in your case you have to serve 3 months.
For any further clarification feel free to write or discuss.

If your appointment terms according to the transfer of employment says that you have to serve only month notice period before leaving and you already are running notice period as have resigned, they cant get you 3 months of notice period. I’d suggest you to go for your appointment/transfer of employment letter for the TCs and do the same.
