Hi,
When the employee decides to put in their papers for a range of reason.. higher studies, wedding, better job etc.
1. can HR people ask for teh supporting documents such as Wedding card, Registeration Form for higher studies etc.
2. If employee is ready to pay up the notice period (As per the provision of the exit policy ), can HR people force him to serve the same?
3. Is the separation date a matter of mutual consent between HR and separating employee or the entire call on the same lies with the organization ?
Please clarify, I am really confused. Some questions are not answered by policies also !!!

Hi monika,
Firstly, HR cannot demand for wedding cards n higher education dtls.
Secondly, regarding serving of the notice period, it will be at the wish of the management whether to relieve the person earlier or not. Employee cannot pressurize the management.
Lastly, 99% of the times during seperation most of the things are done as per mutual understanding only. Even if the employee is leaving the co. for future prospects, he has take utmost care that due to his absence the regular work doesn't get hampered. On the other hand, the co. also should understand his problems & co-operate.

Dear Monika,
All actions should be in accordance with the company policies and principles of natural justice.
1. No the HR cannot ask for supporting documents like wedding cards, offer letter from other companies.
2. No the company cannot force to serve the notice period IF it is mentioned in the Appointment Letter / Contract of employment that the Employee needs to serve a notice period of X days OR pay in lieu of it.
This is because as per contract it is optional.
3. The separation date is not based on mutual consent. It must be followed as per service conditions (Notice Period). However, companies depending upon requirement may mutually agree for a decided date.
