please guide me that who will go for registration under BOCW act and who is laible to pay cess under this act i.e.PE or Contractor and please also give me proper legal references for the same.

Dear Mr.Kumar,
As per law those contractor how are diractly doing civil work, he has to take BOCW Act. If contractor is not taking registration uder BOCW Act then PE is liable to pay cess udear BOCW Act.

Is this Act is applicable in Hariyana? If employer (PE, Contractot) haveing 10 or more workers is liable for registration under BOWC Act. Cess amount is not less then 1% and not more then 2%. This amount is to be deducted by PE on contractor's bill and submitted to the labour office. Where PE (Principal Employer) is suppling civel meterials like cement, rods and any other meterials to contractors, He has to pay 1% or 2% as the case may be of the supplied metrials cost

The Social Security benefits to be extended to the registered construction workers is as follows

*Accident Benefit

*Pension to the the beneficiariies on completion of 60 years of age

*Family Pension

*Invalid Pension

*Death Relief/Funeral Assistance

*Loan & advance for construction of house

*Group Insurance

*Financial Assistance for the of major ailments of beneficiaries and the dependents

*Maternity benefit to the female beneficiaries.

*Marriage benefits

*Tool advance

*Financial assistance for coaching in specialized subjects.

*Grant of loan subsidy to a local authority in any scheme connected with the welfare of the Building/Construction workers

However the above benefits are some examples' But the decision of the Board will be final.
