Dear seniors,
Please guide me if we have engaged one major contractor and he is having licence for hiring contract labour. He awarded work to subcontractor then
1. If major contractor maintain records and compliance on his own account on behalf of sub contractor, subcontractor need licence individualy?
2. As principle employer under BOWC act,PE is responsible for all compliance of major contractor.

So far as Contract Labour Act is concerned,the definition of 'Contractor' under Sec.2(1)(c) of the Contract Labour Act, a contractor includes a sub contractor also and going by the language of Sec.12 read with relevant Maharastra rules (see your state rules) and the prescribed Form of license, it appears that the main contractor is responsible for all compliances.

sir,
it means if major contractor having 2000 labour licence then he can appoint sub contractor without any labour licence right?
But all complaince should be done by major contractor on his account.
