I recently got a descent offer from the company based in my home town. To the immediate effect, I have filed my resignation letter the very next date after serving here for more that 15 months. According to the contract of my employment, I have to serve a 30 days notice period before getting relieved of my duties.
But no where in the appointment letter, it is mentioned that the leave balances expire when you submit your resignation letter under the notice period head, but here, the management is playing a different tune. They are suppressing me not to resign, giving me unrealistic deals and false promises so that I am retained.
Since I have not given the name of my new employer, in the discussion with my manager, he told me that once my current company came to know about the new employer by means of background check, they intentionally get involved in unethical practices such as creating obstacles etc. that can cause harm to me when I have joined my new company.
Listening to this, I am disturbed, not able to sleep properly at night.
I am fair and ethical to my present company, working here for 15 months with full dedication and honesty, but in return, at the time of relieving, these guys are showing their true colours.
If they cause any harm to me, I can also revert back my telling all my pals about the prospective oppurtunities in the market, which can lead to high attrition rate and can press other trigger buttons.
But since I am a simple and well wisher of everybody, I don't want to take revenge or engaged in the conflict, I want to resolve issues peacefully.
Please advise me on this, and give me the optimal solution that works for me. Also, shall I inform my new employer about the poor hr practices that my company follows, so that in the future, if they do any wrong doings, I am least affected or my new employer understands that this is the trend in the HR industry. Shall I invite her(new employer) to go through this thread.

welcome to the "Dog in the Manger" corporate world. they don't live and won't allow us to live.
don't give reference from your company (or give your true well wisher's one for reference). next don't go back-biting. if the management, is poor, the attrition rate will be high and it will be obvious. let them self-destroy on their own.
generally, from my experience, leave is adjusted against notice period (for example your notice period is 30 days and you give 15 days notice. then normally, the 15 days' balance is adjusted against Full and Final settlement or 15 days' salary - the salary for that month is not paid). just put in a word to your new employers that you have come out through the normal process.
when I sent my resignation notice to my employers, I used to mark a copy to my personal id. in case the company threatened, I could always show my personal mail as proof and no blackmail.
you are on strong ground, sleep well, eat well and your ex-employers are shooting themselves in their own foot. just take your new bosses into confidence and inform them about this. once you are in the new job, it's your company's prerogative to take care of you. all the best in your new assignment.

So, they are mainly concerned about the poaching, and because of that, they are building pressure on me. This is clear, that I wont inform them about my new employer. But in the background verification, anyway they will get the information. So, my question is that can they cause me any harm, when their is a background check.
Shall I inform this to me new employer about the poaching scene and the whole issue so that atleast I am safe.

don't speak bad about your company. assure your present boss, you won't take anyone with you.
you are going to your hometown and would have gone on the same salary or a little bit higher. for others, they have may have to shift and the cost of re-locating if they have families - kids studying, spouse working and aged parents - will be high.
in our previous organisations, we had a clause wherein at the exit interview we gave an undertaking that we would not take any of our colleagues along with us for a year. this was fair for the company - good (or disgruntled) bosses take their best workers with them and hamper the process in their previous company.
give reference of someone in any of your earlier job or from the hometown. alternatively give someone from the present company, who you think is your well wisher and fair in his/ her dealing.

if your present employers are bad or management is poor, employee turnover and attrition will show. this is how the corporate world functions and for the kids who come straight from college - office politics, back-stabbing/betrayal and the management attitude acts as a shock. take a balanced view of job - there will be exceptional days and bad days. enjoy the good ones and learn from the bad ones. these will help in shaping you and becoming a better, tougher worker.

You can take up those words said by Ramesh. You don't need to discuss your new employers name to the present company.. You can also take up a chance to inform about this to any higher person in the grade of Head-HR in your new company and to state him/her the situation...
Chill down dude...Company's will place around for retention of employees, you are free to choose your own path..

Speaking badly about your current or previous company will not do any good to you. On the contrary, it will harm you more and create negative image of yours - "If you can talk bad about your current employer...you can also talk bad about your prospective employers". Let’s not talk about ethics and being fair. Ethics is to complete the period of contract and then look for a change. Instead, you are coming across as an opportunistic person. No company will give you hike just because you have been working there for some time. Increments or hikes are given on the basis of performance. Companies will keep you at the same package for years, if you are not adding value to your work and completing your tasks on time. You need to share more about your work, your performance, your productivity, your attitude towards work as well as relation with your seniors and peers.
