Hi every body,

I am Krishnan , a new member and I have a doubt with regard to Contract Labour Law.

I am working in a It Staffing Company -Chennai,providing IT man power to various IT giants in India. We give on contract as well as on Permanent.

We have agreements with each Client separately as per their conditions. Most of the Clients need persons for a [particular period and insits that they have to be on our roll as employees with all Govt Satutaory Benifits.Also many insist on Back ground verification check beforte proposing .On selection these persons (our employees) work at client place.We do raise an invoice based on T&M.

Now one of the client has asked if our company has registered with Labour Dept as per Contract Labour Law !

As for me our deputed persons are our regular employees and deputed to their place under their work order which is for a particular period and hence they only have to register.Once they are relaesed they are in bench with us and reallocated to some other clients. In many cases these persons are also absorbed by the clients.

Do we have to register our company under Contract Labour Law? If so with whom? Where do we get the forms? Can some one help us wirh relevant rules?

first of all i will tell you it is not contract labour law ,it is contract labour (regulation and abolition) act 1970.
first of all if any employer want to hire 20 or more manpower on contract basis
than he has to register himself with labour dept .in that registration it is mentioned so and so contractor will provide this much manpower to us.
now as a contractor u have to take licence if u are providing more than 29 manpower to him ,otherwise no licence reqd.

Dear Malik,
Thanks for the immidiate reply and correction. Do you mean to say that if my company decides to depute less than 29 persons to X company on contract basis then my company need not have registration under that Law? Supposing it is more than 29 Deputees to X company,then we have to take inspite of my company meeting all stautory requirements stipulated by Govt like PF, minmum wages act,leave etc?
I don't understand the logic behind so many registrations to be done for a single company for doing the same business !!

first of all it is 20 employee not 29 ,it was a clerical mistake.
dear you are providing contract labour to one company and if no of employee provided by you is less than 20 than you are not requried to take any licence.
first i will clear you that you will not get licence directly ,first employer has to take registration to hire contract labour from labour dept.
