For buying the land for construction of the factory building you should approach the local property dealers of the area where they want to costruct the building.The appropriate government to whom you are to approach is Haryana Govt. After buying the land you are to construct the same. Therefore it is advisable to conact the Labour Department Industrial Safety & Health wing for proper implementation of the Building & Other Construction Workers (RE&CS) Act,1996 & the Factories Act,1948 for getting registration & licence. You are also to maintain the proper records of the workers/ employees under various labour laws which will be applicabe to your unit during the construction work & after the construction work is over. Plz go ahead.

for buying land to set up industries, you need to contact revenu department of a state, inturn they will guide you which are location indentify by the govt. to setup the industries it also depends the nature of industry your comany wants to setup.

When u decided to buy the land, note few things,

Industries are biforcated into three catogories. Red, orange and Green.

1. Land should be 1 Km away from noticed river and 500 m from not noticed river(water sources like pond,village well, lake etc.,).
2. Atleast 500 m -1 Km away from village.
3. Wet Agriculture land transfermation is too tidus. Dry Agricultural land are some what easy to change Industrial land(concerned Dept. is DTCP). Unclassified land are very easy.

Before purchasing the land, select the area, analyse the area coming under which punjayat, taluk, district etc. Then find the pollution controal board for that area and covery message to JE regarding queries. That person will guide u according to you industries and wat are the polluting substances you are using. etc.

After purchasing the land, Apply for certified copy from register office (copy of Sale deed). apply for Patta and keep the record. Then take survey and soil test of the land in five points. So according to that, the factory, sewage, water storage plan will be ploted and take sign from village president and people(ie. plan approval). Change the unclassified land to industrial classified land.

Have a good rapo with village Adminitration officer and president. After getting the approval, Constraction can be start. and one thing, without help of consultant, you cant get approval from PCB. Because they are indepentent from state and central.

Be cool urself, politics will interept in growning the industries. so be diplamatic. you have to spend bila bila money for all. Even more than 10 lakh also. so take care in negotiation.

After constraction you have to get again No objection Certificate from village president against plan approval while starting.

Factory inspecter will come for inspection regarding the same.

Plz let me know the diff betn the ESI & WC Act, if the area of the particular organisation is not covered under ESi, then which rule is application? ex if an employee met with an accident whose salary is less than 10000/- rs then in which act he have to be claim and if the employee is more than 10000/- which act will be applicable to him? and whether the employer had register his factory under WC Act? and what is the procedure for that or rule?

I think it would be best if you approach the local government departments. Example KIADB (Karnataka Industrial Areas Development Board) which acts as a single window clearing agency. I am sure there are similar departments in other States as well.
Approaching this exercise as a do-it-yourself-kit may be very daunting.

All the best for your new venture which will be more learning to your career growth and should take guidance from your senior HR professional and weigh their suggestions and decide to make best choice.

If you are going to set up factory.

Kindly check your company where they would like to buy especially whether they want lease land of 99 years from the respective State governent allotted area of industrial locations which is cheaper also and legal compliance could be very easy too.

Incase you feel company is going to buy of its own and choose the land according to land classification. Always remember to choose unclassified or Industrial area for smooth legal system. If you still to use rest category you have to strongly push up for CLU (Conversion of Land Use classicifaction), which needs lots of local and government liasoning could be expensive too.

Initially you need to take certificate for District Town & Country planning (DTCP) for land classification certificate and take up with PCB for getting application.

Alternatively you can approach SINGLE WINDOW Clearance system through the either of following departments.

District Industrial Centre (DIC) where the District Collector office prevails and submit required documents, application of SWC alongwith adequeate drawings (15 sets) which they will forward to 5 /6 departments for clearance you don't require to run around all the departments unnecessarily (incaseyou want urgently you pursue each department).

Similarly you can approchh State Industries Promotion wing where you have taken lease land also guiding the SWC which is also easy documentation for clearance.

Thirdly Incase your location is in Panchayat Union, you can please approach the Block Development officer or Commissioner of panchayat and submit SWC application alongwith documents.

Finally after all the department approval to reach the panchayat Union to pass the resolution by the local body clearance ( Chairman and 4 counsisors) to pass. Then only all clearance will be construed to be completed. The BDO will issue running licence upon receipt of fees. After this, respective departments will come for inspection / renewal every year / half yearly depending upon the category of your industry.

Regarding rest like ESI / PF you can directly at respective enforcement officer and accordingly carry out.
