I am working as a Sr Manager in an India based IT company. Due to lack of project work coming to the team, I was asked to resign and that I did and ready to serve 2 months notice period as per my appointment letter clauses. Now the company is asking to serve only one month notice and not ready to pay the other month. I need money to run my household (it was a shock for me to resign, as I was not prepared for that) and time to search for a new job. The Sr. management is now threatening me of termination if I will not be ready to shorten my notice period.

I seek advise on below points:

1. Can they terminate when I have already resigned and ready to serve 2 months notice? I have not received any acceptance from them and resignation was send via official email ID to Director, VPs and HR head.

2. What legal actions can I take to protect my interests - avoid termination, payout deduction, relieving letter etc.?

Keep everything in written with copy your personal email ID. Employer can not victimize the employee more than his job. They need to pay you 02 month notice period. Fight it back.
