Hi, I have a situation with my notice period. I have been working as an process associate for past 1 year 6 months and I got an offer from amazon to join immediately they gave me a joining time of 10 days. Which I accepted after speaking with my team lead. But my current company is not ready to reduce my notice period even though I am willing to pay out. Even HR is ready for that but my operations team manager is asking me to serve 1 month period. I don’t know what to do? He is not willing to negotiate and not accepting my request, also the new company which I want to join is not willing to take me later. I am thinking my career is in danger. Please help me to get out of this situation. What can I do in this situation?

Hi,

Please do not commit any date with future prospective employer without getting confirmation from current employer. Mere confirmation from Team Lead will not be sufficient. HR and your Final superior should accept it. All companies will provide pay in lieu of notice period option but normally will add a line " at the discretion of the employer". so it depends on your nature of work/ whether replacement is identified etc.

Only thing you can do is request with your Operations Team Manager politely and request him to help you.

Alternatively you can quit without information wherein your 1.6 yrs experience will go meaningless. You will not experience certificate/ settlement. It will have impact on your future employment as well.

Also you can talk to HR of Amazon and explain your situation that you need to complete your duties with current employer. Make it more professional and present as if you are very duty conscious.

I already tried speaking with Amazon HR, she said she will cancel offer if I cannot join on 14. And my operation manager from previous company knows this but he is doing it on purpose and not letting me go, for the new company even onboarding is done.I tried everything possible with operation manager. He doesn’t want to help me. Even though there are no responsibilities on me.

Hi,

Understood. Not sure whether your new employer will accommodate without relieving letter from last employer. Also your current employer can sue you for dual employment as you claim your Operation Manager knows that you are joining Amazon.

I am already on notice period. I will be writing a last working day mail and submitting my assets on 11th even if the operation manager is not agreeing. I am gonna surrender all the assets. This is what my TEAM lead told me to do if they don’t let me go

Hi, It is your call. Ensure leaving without information shouldn’t affect your future employment.

Hi,

1. Please check with Amazon if they can buy your notice period from the current company
2. Current employer you can check if you can pay for the notice period in lieu of serving the period which means foregoing all the F&F settlements and paying the difference amount to get relieved.
3. If you are not in a responsible project and still they want you to serve the notice period, pl approach the local labour court since they cannot bind you on notice period even after you ahve agreed to pay for the noticer period not being served.
