Hi, One of our staff has completed retirement age; my company is mentioning to take him as a Consultant. Can you please let me know what all clauses I should mention in the letter?

After his retirement clear all this outstanding statutory dues and full and final settlement. There issue him a fresh appointment letter with all the relevant terms and conditions so that there does not remain any continuity of service. If possible, have a gap between his retirement and new appointment, at least on papers.

Have a clear gap between date of retirement and appointment as consultant.
Proper contractual agreement between employee and company should be drawn up by a proper lawyer.
Pay,allowances,Period of work,work timings,leave,medical care,scope of duty,location of work,terms of exit and termination by company should be included in agreement.

As suggested by our Seniors, first issue him a Superannuation letter appreciating his long & dedicated services & settle his F&FS and if possible; a send of party. May be after 2 months, U can re-employ him as a Consultant or Advisor on a Consolidated Salary only & such persons will be off the roll with No.PF etc., Hence, a good pay can be offered to make him happy to serve the Co. well.
