I am working as HR Manager in a hospital where recently have faced this case, the case is yet under discussion with the higher ups and i need your views and suggestion in this concern.This is regarding one of our Physiotherapist . We have tried our level best to make her see the requirement of hospital and of her colleagues also ( 1 lady & 2 gents) and attend work in Night shifts on rotation basis. But she has refused and has even told HR, that she will not work in Night shift ( minimum of 4 days or maximum 8 days in a month based on duty roster) and her services in the hospital can be terminated. She will not be alone in Night as minimum of 6 lady Nursing staff also will be working in ICU.
All reference records starting from her Appointment Letter (where in she has accepted to work in shifts as per hospital requirement) are enclosed with this mail and request for your guidance.
only thing is, if we are lenient with one staff it may not be a good precedence.

You may proceed with night shift as per your plan and if she does not turn up for work, mark it as absent. Do not permit her to punch the next morning shift when she comes and call her and tell her that she should report to shift only. Now it is her turn to submit resignation and go. If she does not resign but continue to be absent you can take disciplinary action for insubordination. Once a show cause notice is served, she will come to main stream.
One important question, just a curiosity or for academic interest. Is service of a Physiotherapist essential during night also? I have not seen them reporting during night shifts, perhaps due to the nature of their duties.
