We are a 100+ employee company, we don't have any employee whose salaries are less than INR15000/- per month.
We have a Carpentar and an Electrician who comes to fix any issues on a call basis. Apart from these two resources we have tea vendor, who is stationed in our office for the whole day in the Cafeteria.
Under the above conditions is it mandatory to register our company with ESIC.

Dear Patel ji,
The ESI is mandatory as per the Act where the act covers. If your organisation is in the vecinity of the ESI area its automatically cover the ESI but your strength of employees were 20 and there salaries or wages below Rs.15000/-. Since it is mandatory you have to approach to the local office and explain about your organisation and the salary particulars of employees, then the loacal manager will take a decession on your quarry OR he may send the ESI enforcement officer and inspect the records and then take the decession.

Dear Sir,
I wish to make a correction here.. Your local offfice of ESI is only useful to file returns,pay premium etc.
For registration you have to approach the ESIC head office Delhi..
After your registration is done you may never need to approach the delhi office.

w.e.f. 01-10-2010 Act has been amended and ESIC is applicable to all such establishment where 20 or more employees are employed or were employed during preceding the last 12 months and all such estabalishment are subjected to registration with ESIC. For registration one need to approach the Regional/Zonal/Sub-Regional office of ESIC of the respective area to get the registration Done. Establishment shall be regsitered but only those employees will be covered under ESI whose gross wages are less then/upto Rs. 15,000/- per month.
Going forward state Govts. have been instructed to notify the base limit of employees as 10 for coverage of an establishment and it has already been notified in Delhi w.e.f. 01-04-2011.

This is the matter of statutory compliance since ESIC is mandatory as per the ESIC Act 1948 for every organization who is carrying trade or any commercial activities who are having the employee strength 20 or more than 20.
At least company should get registered even after the employee are being paid more than gross 15K/m.
This could be beneficial for employee in terms of medical sickness or major illness if it arises in future for those employee who would be covering the ESIC scheme by govt of India.

As far as I know, if any of the employees in your company are paid less than the laid down salary you should be registered with the ESIC.
However, if such employees are outsourced to another company/contractor, such a company/contractor becomes the employer. You become the 'Principal Employer'. As such your liability remains. In that you remain liable to ensure that the employer has covered the said employees under ESIC.
