Hi! What is the provision in case an employee refuses to participate in ESI and refuses to pay his/her contribution. This is in the case of shop floor unskilled workers whose income is less?

An employee has no choice in this matter. Once covered the ESI contribution has to be deducted from every monthly salary and remitted to ESI Corporation till the time the employee continues to be covered in the ESI Act. The employee has the choice to avail the benefits of the ESI Schemes. Any default on the part of employer has serious penal including criminal consequences.

Epf and esic are social security laws which are statutes to be complied by employer and employee both.

All employees of a covered unit, whose monthly incomes (excluding overtime, bonus, leave encashment) does not exceed Rs. 21,000 per month, are eligible to avail benefits under the Scheme. Employees earning daily average wage up to Rs. 176 are exempted from ESIC contribution. However, Employer shall make their contributions in respect of such employees.
