I am working in pvt ltd company. At the time of appointment company HR told me 8 hours working in one day
But in appointment letter working hour and weekly off is not mentioned. And I am doing 12 hour in day. Suggest me what can I do?

According to Shops and Establishment Act of Maharashtra, the following are the rules:-
Daily and Weekly Working Hours in Shops and Commercial Establishment :-
No employee shall be required or allowed to work in any shop or commercial establishment for more than nine hours in any day and forty-eight hours in any week.
Any employee may be required or allowed to work in a shop or commercial establishment for any period in excess of the limit fixed above, if such period does not exceed six hours in any week.
On not more than six days in a year, for purposes of making of accounts, stock taking settlements or other prescribed occasions, any employee may be required or allowed to work in a shop or commercial establishment in excess of the period fixed, if such excess period does not exceed twenty-four hours.
At least One Hour of Rest for every Five Hours of work is to be allotted. In case of Manufacturing Commercial Establishment this has to be at least Half Hour..
For holidays
Mandatory One day holiday in every week.
Such Holiday is paid irrespective wages are paid on daily basis or at piece rate..
A list of other holidays in the year must be prepared by employer and submitted to inspector for approval or he may allow all holidays specified in Negotiable Instrument Act
For Leaves
Leaves :-
26th January, 1st May, 15th August and 2nd October are Mandatory Holidays. If Employee works on any of these days, he is to be paid Twice the wages + One Compensatory Holiday.
Every employee who has worked for not less than two hundred and forty days during a year [irrespective of the date of commencement of his service,] shall be allowed leave, consecutive or otherwise, for a period of not less than twenty-one days. This can be accumulated up to 42 days.
Other then (C) above every employee who has been employed for not less than three months in any year, shall for every 60 days on which he has worked during the year be allowed leave, consecutive or otherwise, for a period of not more than five days.
All these are Paid Holidays.

Hi I have a a query about Calculating the Leave with wages Amount to be fixed in quotation / ( ctc working) for employees.There fore what % of basic and DA/Spl Allowance be considered and how this % be Calculated to explain to prospective client.
Example Some people quote 5%, some people, 4.81%,while security agencies apply on 4%.Pls can I get the exact figure for this calculation.
