Dear Jayesh,
Before giving a direct answer to your query, I would like to request you to go through the provisions of sections 51, 54, 55, and 56 of the Factories Act, 1948 dealing with weekly working hours, daily working hours, intervals for rest, and spread over respectively.
Since daily working hours and intervals for rest together form parts of the spread over of work, rest hours are exclusive of the weekly working hours. For the term "spread over," though not defined under the Act, it would mean the total hours the worker is under the actual disposal of the employer.

Rest hour and working hours are different. Normal working hours in a factory are from 8 am to 5:00 pm or 5:30 pm. The actual working hours in a factory per day are 8 hours in a day or 48 hours in a week. This means the factory's duty/working hours are from 8 am to 4 pm, which constitutes an 8-hour period. However, workers are eligible for a break after putting in the requisite period of work towards tea break and lunch break. Hence, it is correct to say that the rest hour or break is excluded from working hours. However, all employees who, from the date of entering the factory until their exit from the main gate, are under the control of their employer.

Standard working hours are typically 8 hours a day. Break or rest periods are not usually included within the standard 8 hours of work. However, the hours during which an employee works for an employer indicate that the employee is under the control of the employer. This includes both the standard working hours and the hours of rest.
