we are a client company. we are applying for labour licence. but we take labour from labour contractor, i want to know whether it is applicable to us for PF, ESI, register, deposit PF ESI & other register..

Dear Prasanta,
As per the provision of Contract Labour act,your organization is the principal employer.Now,you can not engage a contractor without registering yourselves as the principal employer and also you need to submit annual return from your capacity.
Once any of your contractor had deployed 10/20 workmen at your premises you need to handover the Form V to the concerned contractor who has to apply for the labour liscence for your organization based on that paper.
Now those contract workmen are the employees of the contractor who shall have responsibility to comply with all statutory matters like PF,ESIC,PTax,etc.Your responsibility to handle all these originate only if the contractor fails to comply so your role for statutory matters for these workmen is more like a coach than a player.
Contract Labour Act & enactments on statutory like PF,ESIC etc,tough inter dependent but are not a single one.So dont mix up all those.

I agree with Arnab. You dont have to apply for labour license instead you have to apply for labour registration certificate by filling form 1 and your contractor has to apply for labour license.
Also, you have to provide form 5 to contractor before he applies for labour license.
Moreover, ESI is not applicable to construction labours so please ensure that your contractor has CAR and WC policy for their staff/workers.

In all statutory cases as Principal employer you are liable for all employee related issues. As client you should ensure that the contract company is fulfilling all statutory requirements. Every month you need to cross check and audit 14 types documents before the processing their bills.
