Dear all,

We have 3 Units comprising of 150 employees in each unit. We do not have any union. Is it mandatory to maintain Works Committee and Model Standing Orders as per ID act? As of now we do not have any Certified Standing Orders.

Please explain in detail about the same.

Dear Hanumanth,

The requirement for maintaining a Works Committee and Model Standing Orders under the Industrial Disputes Act, of 1947, depends on the number of employees in your organization and the specific provisions of state labor laws or central labor laws applicable to your establishment. Here are some general guidelines:

Works Committee: According to the Industrial Disputes Act, a Works Committee is mandatory for establishments that employ 100 or more workers. Since you have mentioned that you have three units, each with 150 employees, it appears that your organization employs more than 100 workers in each unit. In this case, you would generally be required to have a Works Committee for each unit.

Model Standing Orders: The requirement for Model Standing Orders depends on the number of employees. If your organization employs 50 or more workers, you are generally required to have certified standing orders in place. Since each of your units has 150 employees, you would typically be required to have certified standing orders for each unit.

Greetings Mr.Hanumanth,

Maintaining Works committee/Grievance committee, Health & safety committee , POSH committee will help you to avoid any union or groupism ,

for better organization , you can have a certified Model standing order / employee handbook , code of ethics.

According to current scenario provided by you, you are required to have a CSO (Certified Standing Orders) duly certified by Dy Labour Commissioner under whose jurisdiction your Plants are operational.

Insttuting Works committee, Canteen committee posh committee, and such other committees would help you to avoid friction in Plant and ensures good Quality of Work Life. Moreover, from IR point of view, this helps to ensure smooth working in the Plant.
