[LIST][*]Considering scenario in IT industry, when an employee resigns over the system however instead of 2 months notice period is willing to serve only one month notice. [*]The reporting manager does not accept the shortfall in notice period & hence does not approve the resignation request.[*]Post one month, the employee stops reporting to work.[*]In this case, can the employee be considered as ABSCONDING?

If he/she is not responding to your call’s or mails then only you can consider as Absconding.

Dear Swati,
Did you establish communication with the resigned employee? What is his response? Remind him about the terms of contract of employment and give him a reasonable time to respond say, a week to 10 days. Then inform him that legal action would be taken if the employee does not revert back within the set time limit.

Hi Swati,
If the reporting manager and HR has not relieved him from the services and the employee has stopped coming to office, or stopped working, then you to treat him as Absconding.
You can also issue him termination letter on grounds of insubordination.

Dear Swati,
When he resigned, did you issue him a letter stating the clause for release?
Send him a registered letter stating that his release would be due till he completes the formalities. Incase he cant serve the notice period, offer him to buy it out.
Anyhow, he has left your firm. He might not revert till he need the release documents and experience letter.
He is not exactly an abscond case, but one whose release is pending.

Hi Swati, The employee cannot be termed as absconding as formally resignation is given. If the employee is not completing the notice period then "Termination letter" can be issued. Prachi
