Hi All, As an employer can we give LOP/LWP for an unapproved leaves taken by employees. Would like to hear from y’ll on this.

Both are unpaid leaves. If you want to make the leaves as unapproved, then you may use the word "absent" so that it will remain as absent throughout his service or until endorsed as 'leave' without pay.

Ok, Thanks for the reply. Also this can be done even if the employee has got Privilege leaves in this account

I want to add into it
LWP is that leave which is signed and submit by employee and he /she doesn't have leave in his/her account.
Absent means the person is absent from duty without giving any documents
Both have separate role
You can take action against absent but don't take action against LWP as it is approved and signed by HOD or reporting person

Dear Employer,
It is always a prerogative of the employer to sanction Leave Without Pay (LWP) if the employee has no other kind of leave in his leave account. However, if the employee absents unauthorizedly, then the employer should not sanction LWP and instead treat it as "ABSENCE WITHOUT LEAVE" with break in service.

Remaining absent from duty without permission or intimation, tantamount to gross indiscipline and company management can initiate disciplinary action against the concerned employee. But employees on LWP - case is different, that is, person got sanction but he does not have any leave to his credit. Hence salary deduction will be effected for the leaves he has taken.
