i am Dinesh, i was working in one company for last 3 years and 3 months. notice period is 3 months. i plan to leave the company and put resignation letter at 17 Mar 2011. start work in notice period time. Suddenly after ten days of resignation. one day my HR called me and give the relieving order. no need to wait for three months you can go now. then i ask about experience certificate. they told we wont issue experiences certificate in hand. after you join in new company. then we will send to them. not to you. now i got offer from one MNC. they need experience certificate. but my previous employer told me, same story we wont give now. then i ask when for that no response. they really making my life more difficult. up to now i got salary from bank. i was work very hard. but now they making me fool and make my life more trouble, sir i dont know what i will do now. please help me. what is solution to solve this problem. is there any organization help me to get my experiences certificates.

In fact, I regret to say that there is no practical solution to the problem. It is an example of HORRIBLE HR GAME. This is one of the instances which leads the employees to think about a trade union. After all what the HR will get out of holding an employee's experience certificate! An example when good employees become violent.
Any way, talk to the HR person and convince that he is playing with the career of an employee. If that talk fails, bring one other person in the picture for conciliation.

i already told to him person, but he even not consider my words. he told we will send to that company directly. if suppose they need , then ask them to send mail to me. we will send certificate to them, not to you. but new employer not accept this way of getting certificate. i am trouble sir. can i take legal action against him. in madurai tamil nadu, which organization i have to go ? last month only i got married. so more trouble in life. now i got one offer in MNC. but cant able to join there ? please help me.

Please tell your HR guy that it is not the company that decides where you should join and if you do not wish to join for the time being will they not give any service certificate? I think it is right time for you to file a case against that HR person for harassment. Yes, it is a case of mental harassment. You may send a letter to the Director/ Managing Director or such other person who owns the company to issue the service certificate stating that " I have left the establishment on ...date and till now I have not received my service certificate. When I contacted, the HR person (name him ) told me that he would not send it to me but would send it to the company where I join. I don't think that it is material for him to ask where I should join and he is not suppose to give the service certificate to any one else than me. I have offers from two different companies and if I do not get the certificates within two or three days, I will lose them leaving me totally unemployed for the rest of my life. If that happens it will be ...(name of HR) who will be responsible for my failure in career. Therefore, I request you to intervene and issue necessary directions to HR person to issue me my service certificate immediately ,failing which I will be constrained to take legal action. "
You may try the above letter and wait for a couple of days and if they do not respond send a legal notice. Let us see what happens.

Thank you so much for quick reply sir. actually it is small company. HR is not a matter , he is waste what ever management told then he told to me. every thing own by Managing Director. this is his idea only - that wont issue experience certificate in hand. send to company where he join. then i talk to MD directly, he told the same matter. now i got offer. then yesterday i send mail to both M.D and CEO regarding within 5 days of time i need certificate. if there is no response sure i will take legal action. i have one doubt if i have take legal action by labour court, then how much month it will take to finish this case. for quick action any organization will help me - organization like NGO, Labour commssioner. etc., first where i have to go labour court or labour office or advocate.
