my friend was working as an officer in a scheduled bank. she was in her probationary period. due to heavy work load and better placement, she resigned her job. now the organization wants to take revenge of the employee,( it is so happening with all out goers..),they have asked her to work for 3 months continuously with out leave, then alone the resignation will be accepted.on the contra, her colleague, who joined on the same cadre, on the same date of joining, was relieved with in a month after getting Rs.10 000 as compensation.one more colleague, who joined on the same cadre, on the same date of joining, was relieved after getting 3 months salary as compensation.
how can the norms be different to persons of same cadre?will it not affect the right to equality?
my friend is not in a position to stick here for 3 months, as her joining period is only one week , in the case of her new employer.she is not in a position to state the truth to the bank for she fears she may be punished with heavy compensations which may go even till 1 lakh or above(some employees have faced it,it seems).
she has not entered in to any bond or contract stating the tenure of her employment with the bank.but she has signed in her joining report, stating that she will agree to abide by the rules and norms of the bank.
also, no rules and regulations is made known to her so far ..,
in this case, how will you advice me to handle this case? please guide me legally and also tactfully to solve it amicably as the time period available is very very less..

Hey scheduled bank means what,,,,
and your friend can very calmly tell the bank that she does not want any salary for the time worked .. but in her new company also she must have told that she just joined the bank ,,,,

Hi , Private Banks other than nationalised banks are generally called as scheduled Banks. Seniors, please guide me in this regard.

I suggest, ask you frnd to see that what is her notice period during probation period mentioned in the appontiment letter of bank.
If it is 3 months then your frnd can say that I can not serve for 3 month and she will have to pay the specified amount as per the policy.
One more thing, I think she has alredy served few days out of 3 months so she will have to pay only for remainng period.

Thanks for your response.the appointment letter doesnt speak anything about the notice period. there is a clause in the appointment letter stating that you will be governed by the rules and regulations of the bank.but the rules and regulations were not made known at the time of joining , even till date.
how should we proceed on this?
