I am working for software company and not being paid for 6 months. I have resigned for my job
But, my employer is not ready to relieve me even after notice period ends because there is no other resource to take care of this project. I have to join in new company very next day after my notice period ends i.e march 13th. My notice period ends march 12th.
Please let me know what legal actions i can take and how to go legally to get my relieving letter on march 12th itself.

Hi Prasad,
I think your employer is trying to rip off after getting work from you i can suggest you that please talk to the offered organization's hr department and explain the present situation of your organization and then they will help you.
The HR cant ask the documents always.

From your statement it seems that you are following the terms and conditions prescribed in your appointment letter i.e. serving proper notice.
If you have got acknowledgement copy of your resignation letter , you can talk to your future employer on the same lines and move on.

same situation i have faced in my son's issue, but no problem you keep in tough with the offerred hr head and present hr head for smooth change over the job. Be bold and do'nt go for any legal help it creates the negative opinion in both the employers.
In the same situation with my son i have missed the train also, catching the train is not important but counsilling my sons is important. So be happy and u will get proper solution.

Dear Prasad,
Please note that you must be having one copy of resignation letter duly acknowledged by the (nasty) employer. Just issue one notice through any local advocate for not issuing releiving letter, put some damages clause (even though your intention is not to get that).
Show both copies to your new Employer - I am sure that they will accept this and very soon you will be in safe hands.

Labour Commissioner at Karmikra Bhavan, Dairy Circle, Bannerghatta Road, Bangalore. This will work for sure irrespective of your status of 'workman' or not. Do let me know in case you need any assistance here, there will be no need of notice etc, will get them to call your CEO directly.

Is acceptance of Resignation Letter over email is valid.
If the resignation is accepted on 21st Jan, 2016 but I was told to complete three months Notice Period which I coudnl't due to differences or attitude developed between me and the employer and three months period will be completed on 20th April, 2016. Can this period be considered as Notice Period?
