I have been working in a private sector bank as a clerk in Kerala for the past 2 years 7 months.Recently I got married and since my husband is in Dubai,I wish to join him immediately without serving the notice period which is 3 months.I do not need a relieving letter from the bank .If i resign now without serving notice period could the bank take any legal action against me??

why don't you inform them...Put a formal resignation letter. I'm sure they can work things out for you. Since you have served them for a long time now. They can also negotiate with your leaves & remaining work days salary.

The bank could take action. You can talk to the people and see what their reaction is. I wouldn’t expect it to be a 'painless' ride though...

Even you don't require the experience certificate from the bank , it is good to relieve from the company in good amicable terms.. Just send your resignation ( tell the exact fact ) and discuss with them about the notice period duration , request them to reduce the notice period... Trust me they can understand your situation

And now I would suggest you to go to your Boss/Supervisor first and ask him/her to allow you to go early as you can’t stay more with them and just bcz of your valid reason you have resigned and im sure they will understand your situation and allow you.
See the generally according to the terms and condition of an employment contract, an employee have have to serve the notice period. And If a person does not serve the notice period given in his terms and conditions of Employment then he/she needs to pay for the short period or for this lost of Employment. For example: If the notice period is 3 months and a person’s wants to leave after 2 months then he needs to pay back the Company the amount equaling to his 2 months’ salary. But with a situation like you are into, Employer can allow an employee to go early with deduction of amount for short notice period.
Also I would like to remind you that The Industrial disputes Act, 1947 in India first introduced the concept of Notice Period or Payment in lieu of Notice Period to protect the workers.
This system has a very good base since it protects the employee from immediate loss of pay due to loss of job and also protects the Employer by giving it time to find proper replacement and enabling induction and handing over of charge.
