Sir, request your help in ESIC 45A order, Our firm closed business in 2013 but didn't close the ESIC code nor filed the nil returns till date. In May 2021 ESIC office sent a C-18 (adhoc) notice and given a date for a personal hearing.
On the given date our office representative went to ESIC office, but the respective officer not available in the office at that time and due to lack of knowledge my person handed over the documents in the tapal section with acknowledgment. After that also we sent mails to the ESIC officer to know the status of the case.
But all of a sudden he released 45-A order by mentioning that on hearing date, no person is attended and submitted documents are not sufficient and released order with 60 days time.
Request you to please clarify:
1. Is there any mandatory/circular to send a second notice/ paper notice, for personal hearing if we miss the first one.
2. Is there any alternative to resolve the issue because we are not in a position to pay 25% amount to go to appeal.
