Hi All,
I am having problem with my resignation from my current position.
My scenario is that I already discuss this with my manager about my intend to resign.
She told me that she will accept my resignation but she need to find a replacement for my current position but until that she wanted me to hold my resignation.
I find this is not fair to me because I have an offer from other company and they required me to join them ASAP. (after serving my 2 month notice period)
Also I also intend to join the new company ASAP.
What I have done now is discussion with her and I even drop a mail to her about my resignation. But she seems like putting this aside.
I'm afraid that this will hold my notice period here and delaying me joining the new company.
Need advice from anyone here or those who have similiar experience in this matter.

Dear,

i can understand your situation.. but, Don't be panic & worried about it...

First, of all, let clear that, Are you providing the sufficient notice period as mentioned in your employment letter..?

If yes, then you are free to move once your notice period is over.

Law is permitted to employer to putt the clause as notice period to avoid to hamper his business due absconding or to left any employee without intimation, same as like the termination case, that, company is bound to provide the said notice or compensate the notice period.

The reason of putting the notice period is to find out the suitable replacement or take a necessary call on the same within the stipulated time.

Mentioned the notice period on employment letter is assume that, it is sufficient for employer to take a necessary action on the same & both are agreed by signing such agreement, therefore, there is no question to ask to extra or extend of notice period & it can't be bound to employee. but, it can be extend on the ground of mutual understanding & Consent of both parties.

So, extension of contract can not be treated as mandatory unless & until you agreed on the same.

Once you given a proper notice, the ball is in their court, now its their responsibility that, what call need to be taken.

by the law, if you are fulfilling the rules of company, then no one can stop you to relieve.
