Respected Seniors,
I do have question. Kindly read the situation below.
Suppose an employee is having last working day of his notice period i.e on 19th Oct 2013 on Saturday, then Is Sunday salary will be calculated, as the person completed full week.
One of employee in our organisation is having last working day on 19th Oct 2013 i.e on Saturday, then Is Sunday salary will be calculated or not? as we have Sunday paid. 30 days calculation in salary format.

Dear Member,
It will not be calculated as he is leaving before Sunday. So calculate his/her salary by considering last working day. Things could had been different if it was Monday.
But here, it will not be applicable.

Dear Manjiri,

Such is a common confusion.

Please note that an employee is entitled to one paid day off after working for 6 days in a week.

An employee is a person with whom there is an employee-employer relationship.

A person before accepting and signing on the appointment letter is not employee but just a prospect/candidate.

Similarly, an employee who has tendered the resignation and has served the notice period, will not be an employee after the closure of working hours of office on his/her last working day.

So a person is eligible for his salary from his Date of Joining (irrespective of the day he joins) to his Last working day (irrespective of the day he leaves)

So if the person's last working day is Sat, after the closure of office on Sat, he is not more your employee which means he is not eligible for Sunday's weekly paid off.

On the other hand if the person's last working day would have been say Monday, he would have been eligible for said sunday's paid off...

Apart from what all the seniors have advised you, If the notice period would have ended on 20th October i.e. Sunday, then the employee is eligible for the Sunday for which he/she has not worked being weekly off.

You have a system of making payment of all calender days. However you have not mentioned, how you calculate salary when the employee has not worked for full month and has remained absent for certain days in that month. It is a little confusing for making payment for the Off-days such as Sunday. What is done when a person is absent on Saturday? Salary of Saturday and also of Sunday are not paid? or only of Saturday is not paid? In such a case, you must allow the salary for the last Sunday also.

If the notice period expires on Sunday which is a weekly off, then his last working day will invariably be on Saturday on which he can be relieved as no employee can be reieved on a holiday and in that event, the question. is as to how he is entitled to salary for Sunday as he will no longer be an employee on Sunday. However he may be entitled to salary for Sunday, if he is relieved on Monday at the commencement of employment hours.This is my interpretation.

If you have gone through my update I have written that the employee would be eligible to get the salary of Sunday being weekly off, even though he/she is relieved from the work place on Saturday. Because if it had been any working day the employee would be paid for that day.

To be eligible for salary for weekly off, it is not merely necessary that an emplyee should have worked from Monday to Saturday but he should maintain his status as employee on the employer rolls on Sunday also since a weekly off is admissible to an employee only. In the instant case, the employer -employee relationship got severed on Saturday and he is no longer an employee on Sunday. A weekly off is admissible to an employee only but not to an ex-employee. This is my interpretation.

I do appreciate your post and fully agree with you, here the employee's last working date is 19th which is Saturday by default so the employee will not be entitled for Sunday as weekly off. But if the employee's last working day is on 20th i.e. Sunday then being the office is closed the employee will be relieved on the next working day i.e. Monday wherein the employee is not required to do the work, but formerly relieved from his job, in that case the employee is entitled for the pay of Sunday.
I hope that I have not said anything against your interpretation

I believe, Sai sir made the same point. Just the phrasing got you confused.
He means to say in order to avail Sunday's paid leave, the person should have worked in previous week and should have been holding the employee's title.
Adding he said since employee-employer relation is terminated on Sat, he's not eligible for Sunday's pay.
Hope the confusion is sorted. :-)
