Hi there,
I have skimmed through the agreement provided by one of the colleagues on this page, but I think there are a few things missing. Please find below a list of the content of an agreement between a company and a consultant:
- Title of the Contract
- Date of the Contract from & To and duration (1st January to 31st December - i.e., for 12 months).
- Is the contract subject to renewal?
- First Party Name and full address (usually the employing company).
- Second Party Name and Address (usually the employed consultant).
- Purpose/Objective of the Contract.
Second Party:
- Why they were employed.
- What are they expected to do?
- What are their KPIs?
- How much are they going to be paid?
- What are the benefits involved?
- What are their deliverables?
- Number of people involved in this project.
- What are their designations?
- What are their roles in this project?
First Party:
- What is the first party going to provide for the second party to do their job (support)?
- Method of payment.
- What are the working hours?
- What are the consultant's entitlements during their work with the company (in terms of holidays, weekends, public holidays, in case of absenteeism)?
- If the second party fails to deliver.
- If the project was not delivered up to the company's satisfaction.
- Provide the second party with all the information required to do their job.
- In case of a breach of contract from both sides, how will the contract be dealt with?
Authorization:
- Two originals have to be produced to be kept in the custody of both parties.
- Have to be on the Employing Company Letterhead Document.
- First Party Name, date, company stamp, and Signature.
- Second Party Name, Date, Company Stamp, and Signature.
- Witness from Both Parties Legal Advisors Name and Date.
