I resigned from my previous job on 30th January 2009 and communicated this a week before the resignation date, giving the company one week's notice. When I contacted the M.D. on 21st February 2009, he mentioned that I should have given one month's notice before resigning. I explained that one month's notice is typically required when an employee has received an appointment letter or an offer letter, neither of which I had been given. Therefore, I believed one week's notice was sufficient. As a result, one month's salary remains outstanding. Had I informed them three days later, my December 2009 salary might have been at risk of being withheld as well. In a different scenario, informing them a month earlier could have led to three months' salary being blocked.
The M.D. advised me to continue contacting the accountant and visiting the office when requested, assuring me that the settlement would eventually be made. I feel mentally harassed by this situation, especially since my efforts to reach the accountant have been futile.
What steps should I take to recover my outstanding salary? Can I file a case in the labor court against the company?
