I worked in one of the premier ISP/Telecom companies in our country for 10 years and 4 months continuously. However, due to some personal issues, I went on unauthorized leave. After three months, my company terminated my job, citing unauthorized absence as the reason. Now, I have a termination letter from my company in my hand.
Could anyone please suggest the best way to cope with this situation? If I start searching for new jobs, what will be my fate in HR interviews? Will my candidature be considered even with a termination letter?

Were you served with a "show cause notice"? As per the principles of Natural Justice, a chance has to be given to you to explain the reasons for absence. In the absence of this, it is legally wrong to terminate anyone! Hope this helps you.

If your service is terminated for unauthorized absence, there is no need to fight with the company. The company issued a termination letter after waiting for three months. This itself indicates that the company had waited for you to turn up. Therefore, the question of serving a show cause notice and ensuring natural justice will not arise. The company's stance is logically sound as well.
For your future interviews and engagements, the termination letter stating that your service was terminated due to unauthorized absence may pose a problem. However, as someone who has worked for more than 10 years, you can request the company to provide a more favorable relieving order than the one issued.

Thanks for your reply. Yes, on the company's part, they did everything they had to do (by sending warning/show-cause letters to the last known address of mine). However, I didn't reply to them, so they proceeded with termination.

By sending you warning/show-cause notices, the company has done the right thing. I do not agree with Mr. Madhu's contention that they can terminate you without giving any chance to explain.
Now, you need to be honest and explain to your new employer the reasons that compelled you not to join back. Good luck!

When you appear for an interview,frankly tell them the circumstances under which you left your last job.It is possible that they might appreciate your honesty and may hire you.:-P

When you go to an interview, truly explain why you were unauthorizedly absent. A person may be unable to respond to a notice due to family problems, mental health issues, or medical concerns. I have 10 years of experience. Your previous employer should accommodate you accordingly.

An employee can avail of a PF loan after completing 5 years in the company. However, the company will be kind of responsible for the same. The company will only provide Form 13 to the employee, and for other formalities, the employee needs to check with the PF office only.

"Unauthorized absence" is really an act of indiscipline on the part of an employee working in an organization, irrespective of any level. If no instances of punishment are imposed upon the person concerned, then it will spread like a virus to other employees. To address this issue, I have already implemented in my organization a deduction from the salary for the number of days an employee continues to enjoy unauthorized leaves, regardless of the balance of other types of leaves. This salary deduction implementation has proven to be effective and has set a precedent for others to follow. This is merely a financial penalty imposed on an employee for their erratic behavior. However, if the employee repeats the offense, a show-cause notice shall be issued to invite further disciplinary actions.
Any other suggestions are welcome from our knowledgeable HR professionals regarding unauthorized absences.

Nothing strange, my employer's insurance company has issued me a major penalty charge sheet for "unauthorized absence" of less than 40 days. The matter is pending for the last 7 months, although I was one of the most regular employees.

You indirectly created the problem. They waited 3 months for you. You needed to advise them of the problem as to why you did not return. If you go, do not leave on a bad term. Be nice as they might be contacted for a reference by a new company. Be sure you know your reasons for leaving and that they are valid.
With 10 years of service, it will stand you in good stead for a new job. But why did you stay away without addressing the issue?

Employer had done their part by sending you a warning letter and a show cause letter. It was only you who had not responded. At least you must have replied to them once; it may affect your rejoining process. But you quit your job. Right now, you can only do one thing - make a statement to your new employer and explain why you did so.
