Dear Friend,

Your query is not clear with regard to the status of an employee whom you want to terminate the services on account of unauthorized absence. Mere going on unathorised absence for one month is not sufficient ground for termination of the services of pemanent employee.

Did you give any notice to the employee asking him to offer his explanation or not? whether he responded to your such letter or not? what about his status of employment? is he a permanent employee or trainee or probationer ? The termination of an employee will always be depending upon the status of an employee. The services of trainee/ probationer/ contract workman can be terminated either by giving one month notice or payment in lieu of notice if the provision is there in appointment letter on the grounds of misconduct of unauthorized absence etc.

But in case of regular employee, the usual procedure of charge sheet, holding an inquiry, issuing final show cause notice and dismissal order etc are required to be followed as per the principles of natural justice.

Regarding the final show cause notice related to unauthorized absent i would like to seek information from seniors whether the name to be struck off from muster roll should be from date the employee is absconding or from the future date.

Hi Friends, I am new to this forum, and this is my first posting. I am the HR person in a mining company. Our machines are being damaged on a daily basis, and this has led management to conclude that any employee involved in 'damage to company property' act again should be terminated with immediate effect.
