Hi All, Good Morning.. I got a message from my HR when I asked experience letter , he shared below message. I already shared mail to him, due to health issues shared doctor prescriptions also,shared couple of emails also..
"We informed you earlier that you will not be getting the experience or letter since you got terminated because of unauthorised absence (absconding)."
Can anyone please suggest to me how I can get an experience letter and what I need to do?

As per the terms and conditions of employment contract you are supposed to follow proper separation process. In the absence of unauthorized absence HR will proceed with termination process only. Just sharing a Doctor's prescription will not be sufficient and cannot be presented as an excuse. You should properly justify as to why you was not able to serve proper notice period. Under the above circumstances your termination letter will stand as proof of termination of employment contract.

Everyone buys fake doctors certificate and therefore the company is unlikely to believe your excuse.
If you were serious, you would have spoken to HR, met them and taken their approval for not serving your notice period. They are very much in their right to refuse a certificate. Your separation is not following the procedure.
That said, you need to check in Telangana Shop & Establishment Act whether you can demand a Employment Certificate from them. If so, you can still insist on it. But I am sure they will note that you absconded and any future company seeing the document will be wary...

Your separation process is not completed as you didn't quit the job in the manner it's to be done. You should have issued advance notice/resignation, served the notice period as well and relieved formally. Then only you'll have the right to obtain formal separation doc. Otherwise it's not possible. No short cut solution.

As per the law the employer is bound to issue an "experience letter " upon the end of service may be the reason whatsoever. You need to send either a lawer notice or move through the court.
