15th August, 26th January, 1st May are compulsory holidays. If there is any festival and you want to give extra, then you can provide additional holidays. Additionally, there should be a minimum of 8 public holidays you must give as per the festivals in your region.

The holidays applicable to a company are purely an internal matter. Such matters are decided by the management, and if there are standing orders, naturally, the list of holidays will be mentioned in the standing orders themselves. However, 26th Jan, 15th Aug, and 2nd Oct are public holidays that are mandatory. If your employees are willing to work on all other days except Sundays (or on one weekly holiday), you can have only these three holidays in a year. In general, holidays are given depending upon the regional festivals and taking into account religious sentiments.

Hi,

Private Limited or Public Limited or Partnership firm or Proprietorship firm... it is immaterial for deciding the number of Holidays.

1. Central Govt and State Govt offices will follow the Holidays declared by the Govt as Public Holidays.

2. Banks will follow Holidays declared under the Negotiable Instruments Act.

3. All others need to follow the National and Festival Holidays Act applicable in their respective States.

National Holidays

Republic Day, Independence Day, and Gandhi Jayanthi are declared as National Holidays in all States. In Tamil Nadu and Kerala, May Day is also declared as a National Holiday. In Karnataka, Rajyotsava Day is declared as a National Holiday. Most States have 4 National Holidays. If one of these days falls on Sunday and is a declared Holiday, you still declare this National Holiday, and it need not be compensated with another Holiday.

Festival Holidays

There are generally 5 days in many States. Kerala has 7 or 8 days declared as Festival Holidays. These days will be decided every year, and the festivals can be decided by the Management in consultation with employees/union.

So under the National and Festival Holidays act, an organization engaged in any business shall declare 3/4 National Holidays and 5 Festival Holidays. The minimum total will be 9 in States like Tamil Nadu, Karnataka, Maharashtra, Delhi, and the maximum is 12 as in Kerala.

Earned Leave/Privilege Leave

It is guided by the Factories Act or Shops and Establishments Act or Mines Act or Plantations Act. In factories, it is calculated as one day for every twenty days of work. It is the same all over India. In Shops and Establishments Act under which all Banks, BPOs, IT Companies, Call centers come, it is 15 days in a calendar year. It is generally the same all over India. However, I would request you to check your local Shops and Establishments Act.

Casual/Sick Leave

No casual Leave or Sick Leave is applicable as per any law for Factories. If at all these factories provide it, it is always under some settlement or as per contractual terms for executives/non-unionized staff.

Under the Shops and Establishments Act, 12 days of Casual/Sick leave is allowed in Tamil Nadu, and some states have 14 days. Please refer to your local Act.

Leave for General Election

Under the People's Representation Act, all establishments shall declare the Voting Day in their locality as a Paid Holiday for elections for Assemblies and Parliaments and for any by-election for these seats in their locality. This is not applicable for local Municipal/Corporation elections. These Holidays cannot be compensated.

Accident Leave

All those employees covered under ESI are covered for Accident leave under the Act. Those who are not covered under ESI are covered under the Workmen's Compensation Act.

Hi Ambika,

I would like to confirm with you that a company can provide a minimum of 10 holidays, out of which five are compulsory:

1. January 26th: Republic Day
2. May 1st: May Day
3. August 15th: Independence Day
4. October 2nd: Gandhi Jayanthi
5. November 1st: Rajyothsava Day

The other five holidays can be determined by the management.
