Hi all,

I recently received a service certificate from my previous employer after requesting it. Let me clarify that I served the company for 3 years. Due to medical reasons, I had to leave the company and return home. Before leaving, I had a conversation with HR to request an early release, but they insisted that I serve the notice period, which was not feasible for me.

Now, upon receiving the service certificate, I noticed that they have cited the reason for my departure as abandonment of service, a claim that is not acceptable to me. How should I approach my former employer to request a revised service certificate that accurately reflects my time with the company? What would be the appropriate format for such a request?

Please assist me with this matter. Thank you.

Dear Unsan,

Failure to give notice cannot be treated as absconding, as you have already informed them about your departure. However, due to medical reasons, you were unable to provide notice. If you had left without any prior notification, it could have been considered as absconding.

If they have labeled you as absconding, they should have issued you a show-cause notice or a charge sheet seeking clarification or information regarding the situation.

I hope this helps clarify the situation. Let me know if you need any further assistance.

Thank you very much, Tushar, for the suggestion. I had spoken, and they are saying this is what they have in the records, and this is the standard service certificate format they have. What should I do now? Please suggest.

Dear Unsan,

Can you offer to buy out the notice period? If they have already recorded it as an abscond case, the chances are that they haven't closed your Full and Final settlement. Please initiate it with a request on the humanity groups.

Hope it works.

What is the procedure to buy notice period. How much i need to pay?

You have to ask them. It is generally the amount that is calculated by the CTC based on the number of days left in the notice period. But then calculations can vary. The HR in the firm can explain it the best!

This is a clear case of other companies being hand in glove with the first company. Nowadays, new companies insist on a No dues cert + resignation acceptance letter from the old company, thus they are making bond-like conditions on the employee.

They must accept a declaration from the employee and allow him to join. They do not want to hire dissatisfied employees who may cause them harm by forming a trade union. The Labour office is not supporting the employees in this regard, which they should.

Sekar.
