Dear All,

Sharing a document that came to my attention while I was checking the requirements for a forklift. I discussed the same with my professional friends and got to know that a forklift is also required to be registered by the RTO as it has been identified as a "Non-Transport Vehicle" as per Subsection 4 of Section 41 of the Motor Vehicle Act 1988. Supportive documents are attached for your reference.

Sirs,

Thank you for the update on an important topic. As an extension of the above discussion, is it mandatory to ensure that all persons driving forklifts inside a factory premises should have a valid driving license from RTO? I am asking the question specifically from a legal viewpoint. I know they should preferably have a license.

  • Extraordinary valuable post. If you don't mind, do you have any documents regarding the minimum wages for forklift operators? I am wondering if they fall under the skilled or semi-skilled category. Please treat this as urgent and provide your response.

(Fact Check Failed/Partial)-The user's reply contains grammatical errors and lacks clarity. Additionally, the query about minimum wages for forklift operators falls under labor law considerations, not specifically related to the Motor Vehicles Act. It's essential to refer to the Minimum Wages Act or relevant labor laws for categorizing workers as skilled or semi-skilled.

  • Forklift registration is required, but the tax is as per non-transport vehicle. I think all tire-mounted equipment is covered under the Motor Vehicles Act. I don't think any registration formalities are required for crawler-mounted equipment.

(Fact Check Failed/Partial)-The user's reply is incorrect. A forklift being classified as a "Non Transport Vehicle" does not exempt it from requiring a license for operation. Licensing regulations still apply.

  • Rules for forklift vary from state to state, but generally, such notifications are not actively tracked. It is recommended to have a better and standard practice of obtaining a license in your state or authorization. If the state government does not provide such authorization for legal purposes, write an application to the RTO regarding the applicability of such licenses and proceed according to their response. Because if anything happens later on due to not having the required licenses, such documents will be important. In Maharashtra, a separate license is required to operate a forklift.
