Dear Senior,

I would like to know what statutory compliance to be followed when separate building construction activity has been started by a third-party civil contractor with approximately 200 civil laborers in a factory situated in the state of Gujarat. (Statutory compliances from HR, Legal & Safety point of view).

Kindly provide me all types of registers to maintain, or any licenses to apply, as I have to prepare a list of such compliance to do and accordingly inform the contractor for the preparation.

Greetings!!

Please note:
a. All civil labor responsibilities of the contractor, not the company.
b. The landowner has to obtain permission from the Land & Building Department to start construction or extension of the floor, e.g., the 4th or 5th floor.

Hi Imran,

Please scroll through the below-mentioned points for your information:

1. Contractor must have a license under CLRA Act with manpower strength that includes all the working laborers.
2. Notice of commencement of work needs to be submitted to the authority.
3. If five or more interstate workers are employed, contractors must have a license under ISMW Act.
4. If ten or more building construction workers are employed, the contractor should have a Registration certificate under BOCW (RE&CS Act).
5. All amenities provided under BOCW Act related to health, safety, and welfare of workers should be provided.
6. If work is done in the premises of the factory, and the building being constructed is for the purpose of keeping finished goods of the factory, in this situation, BOCW Act will be applicable. But if the building is constructed for manufacturing activity, then BOCW Act will not be applicable.
7. PF and ESIC contributions should be submitted for all workers.
8. Various registers need to be prepared under the aforementioned Acts.
9. Expert advice must be taken to fulfill all the compliance.
