I am Laxmi, working in the garment industry. One employee has been absent for the last 10 days, which is unauthorized. During these 10 days, there was a festival holiday, so the employee is eligible for the festival holiday.

Festival holidays wages are payable only if the emplyee had worked earlier or after the festival , otherwise he will not be eligible for it.

Dear Laxmi,

If any employee takes a long leave instead of Festival Holidays, it will be treated as an absence. We are not required to pay any wages for the holidays, even if it is an informed leave. However, if the employee works before and after Festival Holidays, they are eligible to receive holiday wages.

I completely agree with Mr. Dinkar Sonawane. A workman who had worked on the day prior to a festival, and also worked the next day, is entitled to wages for the festival holiday. However, a workman who proceeds on authorized leave, any paid holiday falling at either end of the leave period or during the leave period, the workman is entitled to wages. Such days are to be excluded from the leave period.
