Dear Seniors,

One of my employees met with an accident in August 2013 and went into a coma. Since then, he has been receiving treatment and wages through ESIC. I have seen in the provisions of the EPF Family Pension Scheme 1995 that a person with Movement Disability is authorized for Medical/Disability pension.

If so, kindly advise me on how to process his papers.

Dear Mr. Budhpal Singh,

For disablement pension, along with Form 10-D, a medical certificate (in compliance with the format of EPFO) from the District Medical Officer has to be enclosed. The minimum disabled pension is Rs. 250, and the member pension is Rs. 1000.

Hence, it would be better to apply not for disabled pension but for reduced pension after attaining 50 years of age, in case the member is eligible for the minimum pension only. Towards the reduced pension, the member will receive Rs. 721.

Dear friends,

It is very regrettable to state that the family pension slab and disabled pension have not been revised in compliance with the new amendments, namely the ceiling salary of Rs. 15,000 and the minimum pension of Rs. 1,000 respectively. I believe that the Central Trade Unions will give due stress and concern to these vital issues.

Dear Abbas ji,

I am not sure, but I feel the disablement pension will be a minimum of Rs. 1000/- per month. I just went through the notification enhancing the pension to a minimum of Rs. 1000/- per month. According to me, disablement pension is one type of monthly member's pension, and the notification states that the monthly member's pension, including any relief payable to any existing or future member under this paragraph, shall not be less than Rs. 1000/- for the financial year 2014-15.

You are right. When I asked my friend in EPFO regarding the procedures to apply for disabled pension, he told me the above statement. Usually, they know the implementation part and accordingly I responded. Sorry for the mistake.

But the ceiling of family pension is Rs. 2051. This was introduced in compliance with a salary ceiling of Rs. 6500. Even after the ceiling was hiked to Rs. 15000, this didn't get enhanced. Accordingly, I clubbed the above reply to this and the mistake occurred.

What will happen when this employee comes out of coma and declared medically fit for duty after certain period say 3-5 years & company also want him to join again for duty.

Dear Budhpal Singh Ji,

Good question. This was not thought of. Disablement pension under the Employees Pension Scheme is only for permanent total disablement. A person in a coma cannot be said to have permanent total disablement.
