If an employee does not collect their salary for X number of years, or let's say they have foregone their salary (not officially), then what happens to that salary? Does it need to be credited to some government account after a said number of years? If there is an Act and Section (which there should be), please also assist me with that.

Hello Beckmandal,

Please provide more details of the issue or situation, as it has been ages since all government employees' salaries have been deposited into salary accounts in their respective banks. When the salary is deposited into the individual's bank account, it is no longer government money. It is up to the individual concerned to make proper arrangements with his/her bank branch to handle the money.

Hi,

Yes, there is an Act called the West Bengal Labour Welfare Fund Act. Please read this paragraph.

Under Rule 4 of the West Bengal Labour Welfare Fund Rules, 1976, every employer of a factory or commercial establishment, etc., shall send the Welfare Commissioner, West Bengal Labour Welfare Board, unpaid accumulation, i.e., the sum of money due to the employees on account of wages, bonus, gratuity, etc., but actually not paid to them within a period of 3 years from the date on which they become due and all fines realized from the employees of its establishment during the quarters ending on 31st March, 30th June, 30th September, and 31st December within 15 days from the closing of each quarter. The payment of unpaid accumulations and fines shall be accompanied by a statement giving full particulars of the amounts paid.

Any amount payable by an employer to the Welfare Commissioner, West Bengal Labour Welfare Board, may be paid in cash or by bank cheque or by money order or by bank draft.

Such unpaid salary is credited to the unpaid salary account. The employee is required to lodge an application with the Drawing & Disbursing Officer, who, in turn, must verify the records and approve the debit voucher for payment by the Paying Authority.
