A person joins an educational institution as a full-time teacher at the age of 60 years. Whether he is eligible for gratuity after he completes five years of continuous service, I feel he is eligible. Request the honorable members to please respond.

Dear Raj,

Gratuity is paid out at the time of superannuation (if you retire at the age of 58), when you retire (at any other age), or resignation, and in the event of your death or being rendered disabled because of an accident or illness. You need to have at least five full years of service with an employer to qualify for gratuity.

Dear HR Colleagues,

I am currently managing a company in Dubai and require your advice regarding the calculation of unlimited employment termination as outlined below:

Example:
Employee S joined company A on 17th December 2006 and will be terminated on 19th March 2012, inclusive of a 30-day notice period. S's basic salary is AED 11,000, and accommodation allowance is AED 12,000. S still has unused leave of 10 days from 2011, and the employment contract stipulates that S is entitled to an incentive of 25% of the gross salary.

Questions:
1. Formula for calculating End of Service Gratuity
2. Formula for calculating Unused Leave
3. Formula for calculating Repatriation Expenses
4. Formula for calculating payment in lieu of the notice period
5. Formula for calculating any other components of termination (if applicable)

Please provide me with immediate advice.

Dear Sir, Yes he is eligible for gratuity. There is no restriction of Age. After of completion of 5 years at any stage beyond 60 years also, he is eligible for gratuity. D.Gurumurthy HR/IR Consultant
