It is very clear that that qualifying service period for getting Gratuity Payment under section 4 is completion 5 years continuous service. Despite having this very clear legal provision, I come across a Judgment of Madras High Court in the matter of Mettur Beard Sell Ltd that it allowed payment of Gratuity to the employee having completed only 4 years 10 months service (On the pretext as per Sec 2A at the 5th year employee has completed more that 240 days service). I am enclosing herewith the copy of this judgment for perusal of all learned society of this site. After going through this judgment please let me know your observation duly supported with legal citation stating clearly whether Gratuity Payment is to be made to the employee who completes 4 years 11 months and 27 days service.
