Hi i am working as a project coordinator in jaipur on contract basis. My contract is going to be finished on 31st March 2018 and i am planning to go to maternity leave from February 2018. So please confirm whether i am eligible for two months maternity leave (Feb & March) as per my contract. I am having ESIC benefit also.

Maternity Benefit is also a part of the ESI benefits under the ESI Scheme. You are entitled for full benefits, not limited to Feb & March, as per its terms and conditions. So check up with your local ESI Office on your entitlements. You may revert thereafter if you have any query left.

ESI provides both sickness benefit, i.e. medical treatment during pregnancy as well as maternity benefit i.e., ESIC provides 100% of average daily wages in cash up to 26 weeks in confinement . ESI benefit is conditioned on the basis of the compliance during the contribution period. The table below gives the position. Since you are seeking the benefit during Jan to June 2018 period, it would depend on whether you had contributed to ESI during April to September '17 contribution period. The benefit period is not dependent on the service period, it can exceed it. So also, as you are contributing in Oct 17 to March '18 contribution period , your beneficiary period would extend to December 2018.

1. Dear member, ESI Act, 1948 do not discriminate between employees or insured woman on the basis of casual, on contract or on fixed term basis on on any other basis. What is important the insured woman must have completed and paid contribution for minimum period as laid down in the rules framed under above Act.
2. The question whether you are eligible to get maternity benefit as well as medical benefit under said Act is a question of fact and therefore we are not in a position to answer/explain the same correctly. Therefore, it will be more better if you may contact your ESIC Branch Office to which you are attached with having your PEHCHAN CARD issued under above Act.
3. Maternity Benefit is paid under above Act by ESIC Branch Office on the basis of medical certificates issued by ESIS Dispensary or ESIS Hospital to which you are attached. Therefore, it will be more better if you may also contact concerned doctor with having your said PEHCHAN CARD.
