Please provide clarity on whether registration and records under the Factory Act apply to contractors working in a factory. Who is the licensing authority responsible for issuing labor licenses for contract laborers working in a factory? Please include relevant legal references.

A contract worker working in a factory, as defined in the Factories Act, is also a worker as defined under section 2(l) of that Act. Therefore, all the records and registers required to be maintained under the Factories Act in respect of a worker directly employed by the Principal employer have to be maintained for the contract worker as well.

Licensing Authority

Regarding licensing, the authority competent to issue the license under the Factories Act may differ from state to state. Therefore, please contact the local labor office or the Commissioner of Labor of your state.
